This Privacy Policy describes how MyBeautyIQ LLC (“MBIQ,” “we,” “us,” or “our”) processes personal information related to the use of MBIQ’s mobile application and the website https://mybeautyiq.com/, including all pages, domains, content, services, and products available through said mobile application or website (collectively, the “App”). By using the App and/or submitting your information to the App, you agree to the personal information practices described in this Privacy Policy. Undefined terms in this Privacy Policy have the same meaning as in our Terms of Use.

Personal Information We Collect

We collect personal information about you when you use the App. When registering for an account, you must select a profile type: Student, Educator, or Salon Owner. The personal information we collect depends on the profile you select, and includes:

– Contact and account information, such as your first and last name, phone number, mailing address, and email address.

– Profile information, such as your education, experience, professional license status, interests, and any other information you choose to provide to us.

– Location information, such as the address of space available for rent or the location of a Class.

Additionally, when you use the App, we automatically collect personal and other information about you and your use of the App. This information may include:

– Usage information, such as the content you view, searches you perform, and Classes you create (Educators) or sign up for (Students).

– Location and device information, such as your IP address, device type, and operating system.

– Log data, such as details about when and how you use the App.

– Information collected through cookies and similar technologies.

**Personal Information We Collect from Third Parties**

We also collect personal information from other sources, such as:

– Third-Party Services: If you register for the App using a third-party service, such as Google, Apple, or Facebook, you direct the third-party service to send us information, such as your name and profile information, as controlled by that service or as authorized by you via your privacy settings with that service. For more information, please contact the third-party service or review their privacy policies.

– Professional License Verification: If you are a certified cosmetician, licensed professional, or affiliated with a beauty school, we may use a third-party service to verify the status of your professional credentials.

– Payment information: We use a third party to process payments on the App. In connection with these payments, we may receive transaction details such as the date and amount of payment.

**How We Use Your Personal Information**

Provide the App. We process the personal information described above to provide you with the App, including to:

– Enable you to use the App, communicate with other Users, and pay for services purchased through the App.

– Enable Students to search and sign up for Classes.

– Enable Educators to create and post Classes.

– Enable Salon Owners to list their venues for rent.

– Perform contracts with Users.

– Provide, improve, develop, and secure the App.

– Prevent fraud and malicious activity.

– Provide customer service and training.

– Personalize your experience.

– Verify information provided by you.

– Create and maintain a trusted, safe, and secure environment.

– Resolve disputes with, or among, our Users.

– Enforce our Terms of Use [add link].

– Comply with our legal obligations.

Marketing. With your consent (where required by applicable law), we may use your personal information for marketing purposes. For instance, with your consent, we may contact you at the mobile phone number that you provide to us by way of direct dial calls, autodialed and prerecorded message calls, and text messages. You may opt out of receiving promotional communications by adjusting your preferences within the App, or by following the opt-out directions within a promotional email, call, or text message.

Third Parties. In some circumstances, we may disclose your personal information to affiliates, business partners, contractors, or third parties. For example, we may use a third-party service to verify the status of your professional credentials and process payments within the App. We may also use third-party infrastructure services to host and provide the App.

Other Users. We will disclose your personal information as directed by you or as necessary to provide our products and services within the App. For instance, Educators who create a Class will receive the names and contact information of Students who sign up for that Class.

Business Changes. If MBIQ becomes involved in any merger, acquisition, reorganization, asset sale, bankruptcy, or insolvency, then we may sell, transfer, or share some or all of our assets, including your personal information, in connection with such transaction.

Your Rights

You may exercise the rights described in this section consistent with applicable law:

– Updating Your Information: You may access, update,

 and correct much of your personal information through the App. You are responsible for keeping your personal information up to date.

– Data Access and Portability: In some jurisdictions, you may request copies of your personal information and/or request that we transmit this information to another party.

– Data Deletion: In some jurisdictions, and subject to certain exceptions, you may request that we delete your personal information.

– Opt-Out: You may opt-out of receiving marketing communications by adjusting your preferences within the App, or by following the opt-out directions within a promotional email, text message, or other communication.

Additional Provisions

– Sale of Personal Information: MBIQ does not sell its Users’ personal information to third parties.

– Non-Discrimination: MBIQ will not discriminate against you if you exercise any of the rights or choices provided by this Privacy Policy or applicable law.

– Retention: MBIQ retains personal information for as long as needed or allowed in consideration of the purposes for which the information was collected.

– Do Not Track: At this time, the App does not recognize or respond to “do not track” signals.

– Children: The App is not directed at or intended for use by children. MBIQ does not knowingly collect information from children under 16 years of age. If you become aware that your child or any child under your care has provided us with information without your consent, please contact us as described below.

Security

We have implemented reasonable administrative, technical, and physical security measures to help protect your information against unlawful or unauthorized access, loss, destruction, or alteration. Although we are continuously monitoring and updating these measures, please note that no organization can guarantee perfect security.

Updates

MBIQ reserves the right to modify or update this Privacy Policy at any time, in accordance with applicable law. Any changes to this Privacy Policy will be in effect as of the “Last Updated” date at the top of this Policy. By accessing, using, or logging into the App after the “Last Updated” date, you agree to the changes to this Privacy Policy.

Camera Access

To provide certain features and functionality, our app may request access to your device’s camera. This access is required for specific purposes, such as capturing photos or videos for user profiles.

We want to assure you that your privacy and the security of your data are of utmost importance to us. We do not access or use your device’s camera without your explicit permission, and we do not store any media captured by the camera on our servers unless explicitly authorized by you.
